Earnest Money-Let The Buyer Beware.....




   Earnest Money has become one important component in most real estate contracts. It is the assurance the buyer gives to a seller to show that they are serious about buying there home. When a seller puts there home on the market to sell they are looking for the best terms, highest net and fastest closing time frame. Once the home is under contract it is taken off market and put into pending status. This normally halts the activity on the property while it is under contract. Any interested buyers other than the buyer under contract with the seller can now only be entertained as back-ups. Should your contract fall through it gives the back-up offers a chance to be in first position to purchase the home.

                              A contract can have a life span of 30 days up to an astounding 120 days or more depending on the type of sale it is or the terms of the contract. Most short sales can be very lengthy and cause the home to be off market actively for months. Even if the home is a regular home purchase with no special circumstances such as a Foreclosure, Estate Sale, or a Divorce Sale it can still be at least 45 days before it escrows. Keep in mind the entire time the home is not being marketed to additional buyers because the seller has committed to the buyer that won the contract.
                 
                                 This is where earnest money comes into play. The buyer offers earnest money of usually 500.00 or more to solidify the contract.  It is an act of good faith towards the seller. Earnest Money assures the seller that he/she is taking there home off market for a willing, ready and hopefully an able buyer.
In some cases 500.00 is sufficient for earnest money. In a market where there are multiple buyers bidding on one home or if the seller has already had a bad experience with another buyer, they may raise earnest money to 1% of the purchase price or more. It can be a hefty price tag and is normally paid per the contract guidelines once the home is under a binding agreement.

                         Earnest money is one of the first expenses buyers encounter when buying a home. If you have not been informed by your agent or lender during your buyers consultation it can hit you by complete surprise. Also if you do not perform to the terms of the contract or fail to secure your loan to purchase the home before your financing contingency is up, you may be in danger of losing your earnest money to the seller. There is also a due diligence period that a buyer uses to get an inspection, find out about the HOA Covenants Codes & Restrictions, conduct a survey or anything you choose to use that time for to find out if this is the right home for you. All of these are conducted at your own expense. However, if you fail to inform the seller before your due diligence period ends that you no longer want the home ect, than you may be in danger of losing your earnest money to the seller as well. 

                           It is so important to work with an agent that can help you navigate through the process. To let you know which contingencies in the contract apply to your circumstances. Also to inform you when your in danger of losing your earnest money. Or when you need to put an amendment to the contract in play to safeguard your earnest money.

Inexpensive do it yourself projects that add value to your home!

Everyone wants to sell there home for the maximum price. Forget what you have been told in the past no two homes are exactly alike. Yes, they may have the same style and number of bedrooms but there is always that one item that sets the homes apart. Making one home more desirable and appealing then the other. It could be the marble bathtub, or the heated floors that makes the home stand out. Maybe its the rose bushes out front or the updated appliances that sends a buyer into that got to have it mode. Whatever the case we can all agree that the home that is most appealing is the one that will sell.
                                                  
  Here are a few inexpensive ideas that can help your home stand out.....

Clean, clean, clean, clean, clean and the clean some more. One of the best things an owner can do is to clean the home before it hits the market. The kitchen and bathroom are the two major places in the home that buyers scrutinize. Clean counter tops, floors,windows,wipe down appliances and handrails just to name a few things. The most important dirt is the dirt you think they are not looking for. The grime in the corners or the baseboards. Wiping down the blinds and the ceiling fans. You could have the nicest lot on the block. If a buyer can't visualize themselves there because its not tidy than it will never sell for the price you want. Go back to basics like the Karate Kid wax on wax off.. 

                      De-clutter the home and open up the possibilities. One of the worst things you can do is put your home on market before you have removed excess baggage. Decluttering the home gives added space. After a buyer has seen the kitchen and the bathroom there headed full speed ahead to check the closet space. Get rid of all those extra clothes or shoes you can no longer wear. Ladies, I am pretty sure those striped bell bottoms with the rhinestones on the pockets aren't coming back in style this season. For the men you must get rid of that Members Only jacket. I feel your pain my husband just got rid of his a few weeks ago for the 8th time. If he pulls it out of the trash one more time when I am not looking I will be forced to bleach it. Let it go! 
                
    The garage is another place where we love to place unwanted items that we just can't seem to throw away. Go through and get rid of it. When in doubt throw it out. Or better yet have a garage sale!$$$

                        Painting not only gives your home a fresh smell it also brings a dull home to life. However, this isn't the time to let your creativity be your guide! Remember paint soft colors an eggshell, or  pastel green. Refrain from wall paper because most buyers have remove wall paper on there to do list right under change shag carpet in the living room. 
         
                         If you can get away with a good vacuum and cleaning of the carpets, it will not only save you a small fortune it will also enhance your homes appeal. Hopefully most of the carpet is neutral in the home. This way the buyer will not have to worry about buying new carpet as soon as they move in. 
               
                       You don't have to break the bank on the outside of your home unless it really needs its. Keep the lawn mowed and the edges trimmed. Stop in at your local garden supply store and pick up a few colorful flowers to plant. If you pass a garage sale buy a few small statues to go on display around the yard. Don't forget the welcome mat.
            
                       Doing these things can add hundreds to your bottom line without spending a fortune. It's important to remember that although you want to do things that make your home standout your selling this home. Those costly upgrades or expensive additions will unfortunately not be yours to enjoy once the home is sold. Instead benefit from the money you saved by putting it in your Rainy Day Fund..

The 411 on Down Payment Assistance..

              Years ago potential homeowners had to come up with there own down payment assistance (dpa). Many home buyers saved for years or had to borrow the money from somewhere else making the home buying process often daunting. Dpa use to be as high as 20% of the purchase price. In many cases this was extremely difficult for most potential home buyers. Luckily in recent years this number has shrunk dramatically to about 3.5% for FHA.

              A down payment represents a fraction of the total cost of a home. For instance if your buying a home for $100,000 with a down payment of 3.5% your down payment would be $3500.00. If you were purchasing a home in the amount of $180,000 with a down payment of 3.5% your down payment would be $6300.00.  When you factor in other cost such as closing cost, moving cost and other fees buying a home can get pretty expensive.  
     
                  Down payment programs enlist participation from nonprofit organizations or municipalities. They assist families in covering the cost of there down payment. Many people believe (dpa) is only for low-income families. This is truly not always the case. Although there are guidelines for each program dpa is worth looking into. Many agencies require that a buyers loan have full documentation. They also require the buyer participate in a home buying class.
   
                 There are different types of assistant programs for instance some programs may only be available in a particular area like the Citylift or Beltline program. Or if the buyer is in a particular career field such as the Good Neighbor Next Door Program. This program is available for teachers, fireman, police officers or emt's.  There are also programs with guidelines on income.

                  Whatever your individual circumstance everyone should look into down payment assistance programs. As Benjamin Franklin once said ( A penny saved is a penny earned!)

Be Choosy When Choosing Home Insurance ....


The past few weeks many areas have been hit with extreme storms. Whether its Global Warming or good old Mother Nature causing these storms, homeowners should get the facts about what they need to do if there home is damaged. The first thing to do is read over your policy and talk with your insurance provider to find out what would be covered if the unfortunate should happen. No two policies are the same, limits of liability, coverage levels and exclusions can vary.

There are different types of coverage included in a homeowners policy for instance



Coverage A -Damage to your home
Coverage B -Damage to other structures including garage, deck or swimming pool
Coverage C -Loss or damage to the contents of your home
Coverage D -Loss of use in case your home is not inhabitable
Coverage E -Personal liability to third parties
Coverage F -Medical payments to third parties




You will need to check your individual declaration page to find out what coverage you have. A policy will usually cover replacement or repair of your house and its contents up to the expressed limits. It can also protect you if there is a liability policy in the event someone is hurt or injured on your property due to your negligence.

Many standard policies cover storms including hail, tornados & you guessed it wind damage. Most policies don't cover earthquakes and floods unless the homeowner adds additional coverage beyond the basic. Homeowners can be hesitant to file a claim because they do not want a rate increase. Most states prohibit insurance companies from canceling your coverage or singling you out for a rate increase due to an Act of God damage claim. Every insurance carrier is different there may be a policy in place on making excessive claims or other policies that may hinder you from making a claim. That's why it is so important to ask questions and read the fine print.

Comparing home insurance policies requires diligence and patience. A savvy shopper will compare more than just the annual premium rate offered through each company. 

You may be saving on the premium for one company because your lacking an important component inside the insurance policy. The problem will arise when your claim is denied because you do not have enough coverage on the policy. Having peace of mind to weather the storms will depend on the policy you choose.

Tax Resolutions for 2012



Many people resolve to be wiser with their money in the new year, and it just so happens that being smart about your taxes is a good way to get started.

    Promise to give yourself a tax check-up twice a year. Don't let yourself be shocked when tax time rolls around - the psychological and financial stress of being unprepared for a big tax bill can take a major toll. Do yourself a favor by checking on your tax liability a couple of times through the year. If you need to make adjustments to your withholding, do so as quickly as you can. Even if you find that nothing needs to be changed, you'll have something to smile about and one less worry to occupy your mind.
  • Get started now. Procrastination can be your downfall - it often happens that the longer you put something off, the more daunting a task it seems. And the last thing anyone needs is an excuse to be more overwhelmed by the thought of working on taxes.   • Set up a filing system - and stick to it. The flurry of paperwork is stressful enough when you're doing your taxes - not being able to find a necessary slip of paper only makes it worse. What you don't know can hurt you (lead based paint)

There are a lot of homes for sale on the market at this time. Great deals seem to be around every corner. Many of the homes are in older subdivisions that were built prior to 1978.  These homes may have paint that contains lead called (lead based paint). Lead from paint, chips and dust can pose serious health hazards if not taken care of properly. 

Knowledge is power! Here are the facts to help you make an informed decision!

Lead can enter the body in many ways here are a few
* Putting your hand or objects covered with lead dust in your mouth.
* Eating paint chips or soil that contains lead
* Breathing in lead dust (especially during renovations that disturb painted surfaces)

Who can be harmed by lead based paint?
* Everyone can be harmed by lead based paint especially babies and young children. Children's growing bodies absorb more lead. Children's brains and nervous systems are more sensitive to lead.  Also expecting mothers need to be guarded against the harmful effects of lead.

Children with high levels of lead can suffer from
* Damage to the brain and nervous system
* Behavior and learning problems
* Slowed Growth
* Hearing Problems
* Headaches

Adults can suffer from
* High Blood Pressure
* Digestive problems
* Muscle and joint pain
* Nerve disorders
* Difficulties during  pregnancy
* Memory and concentration problems

Where can lead based paint be found?
 * Inside and outside of the home
 * In soil around the home that has been picked up from exterior paint or other sources

Lead based paint that is in good condition may not be a hazard. Lead Based Paint that is peeling, chipping, chalking, or cracking needs immediate attention.  It can also be a hazard when found on surfaces that children can chew or get a lot of wear and tear such as
* Windows and window sills
* Doors and door frames
* Stairs, railings and banisters
* Porches and fences

You can get your home checked for lead hazards by doing the following.
* A paint inspection it will tell you the lead content of every painted surface in your home. It won't tell you whether the paint is a hazard or how you should deal with it.
* A risk assessment tells you if there are any sources of serious lead exposures (such as peeling paint and lead dust) It also tells you what actions to take to address these hazards.

A simple blood test can detect high levels of lead. Your doctor or health center can do the blood test. They are inexpensive and sometimes free. Your doctor will explain what the test results mean. Treatment can range from changes in your diet to medication or a hospital stay.

Holiday safety tips for your home.

The holiday season is a great time to draw attention to your home. Decorating your home with Christmas lights, burning candles and inviting guest into your home makes the season magical. Its so easy to get lost in the holiday spirit we sometimes forget to be safe. To keep your family safe this holiday try these 10 tips..


1. Don't forget to make sure electrical connectors are off the ground and away from metal rain gutters when your hanging your lights. Use plastic clips to avoid using metal nails or insulated tape will do the trick.

2. Connecting more than one extension cord can be a hazard, use a single cord that is able to reach the outlet without stretching, that can't get easily tangled.

3.A fresh cut tree is more resistant from ignition let that be your first option.  When purchasing an artificial tree look for those labeled (flame resistant)

4. Make sure all smoke detectors are working and test them monthly.

5. It's a great idea to install a Carbon Monoxide monitor in your home.

6. If your gas fireplace has not been inspected by a qualified service provider, the glass panel is broken or cracked do not use it.

7. Cut off all lights before going to bed or leaving the house.

8. A good way to prevent CO hazards in your home is to always have a qualified heating contractor perform a yearly maintenance check of your furnace and venting system, and clean or replace your furnace filter frequently during the cold months.

9. When entertaining guest provide plenty of large, deep ashtrays, and check them frequently. Cigarette butts can smolder in the trash and cause a fire, so completely douse cigarette butts with water before discarding.

10. Use your homes burglar alarm system when your not home. If your planning to leave for the holidays never discuss plans with strangers and get a trusted neighbor to keep a eye on your home.

READY TO PURCHASE A HOME? HERE'S WHAT YOU NEED FOR THE LOAN

The loan process can be a monstrous experience for most first time buyers. Many lenders have different pre-qualification standards and a seemingly endless process to take you through.  However, with a little credit knowledge and preparation before you speak with a lender buying your first home can be a breeze.

Here are the basics most lenders will ask for on your initial meeting.

  * Most recent 30 days worth of pay stubs, 
  * Last 2 years of w2 or tax returns for the self employed
  * 2 months of bank statements of all your accounts
  * Copy of your social security card and drivers license 
  * Name and contact information for your landlord or leasing center
  * Your debts and assets

This information aids the lender in knowing your maximum purchase price, your debt to income ratio and if you are able to purchase a home at this time. If you are unable to purchase at this time they are able to assist you by giving tips and pointers on what you need to do now to buy in the near future.

A few tips about your credit -
* Even if you have paid an account in full it is not removed from your payment history.
Collections accounts can remain on your account for 7 years from the date of the accounts last activity.
Credit accounts paid as agreed by you can remain on your history for up to ten years. For those accounts you have defaulted on they may be seen for as long as 7 years.
Courthouse Records vary in the amount of time according to the account. Judgements with the exception of a few are 7 years form the date filed.  Bankruptcy chapter 13 can remain 10 years from the date filed whether the are non-discharged or non-dismissed.  Chapter 7 and 11 may remain 10 years after the date filed.
Tax liens that are paid remain for up to 7 years and unpaid tax liens are indefinite

One of the most important things you can do is safe guard your credit. Pull your credit history once a year to make sure it is in good standing. Georgia residents are allowed one free report each year by going online to one of the credit bureaus and answering a few personal questions. Or you can have your credit report mailed to you.

HOLIDAY SPARKLE WITHOUT BREAKING THE BANK



The holidays are fast approaching accompanied by good food and guest. How do you get your home ready for the holiday season without going broke. Instead of breaking open your piggy bank and retrieving the sock under your mattress try these tips instead.

BELTLINE AFFORDABLE HOUSING DOWN PAYMENT ASSISTANCE PROGRAM

If  your a resident of Georgia by now you have heard about the Beltline. The BeltLine is a former railway corridor that circles Atlanta. Transit, parks, walking & bike trails will make-up the Beltline. The project will connect 45 different neighborhoods, redefining the meaning of historic preservation and a more effective way of utilizing green space.
To make housing more affordable the Beltline Affordable Housing Trust Fund was created to assist homebuyers with down payment assistance.  The programs allows buyers to receive up to 30% of the sales price at a zero percent interest rate as a soft second.  What is a soft second? A soft second mortgage is a second mortgage with subsidized affordable rates, which is usually combined with a traditional first mortgage. To be eligible for the soft second mortgage the first mortgage must be a conventional, FHA or VA 30-year fixed.

Below are the program highlights

The first time homebuyer requirement is waived for borrowers moving into a target area within the incorporated city limits of Atlanta.
The current residence must be sold prior to closing on the new home.
Borrowers moving into a non-target area must be first time homebuyers.
Maximum purchase price cannot exceed $252,890.
The property must be owner occupied.
Single-family detached homes, Townhomes and condo are the eligible properties to receive program benefits.
The deferred loan requires no payments and is forgiven if borrower occupies the property for at least 15 years.
Loan proceeds may not be used to pay-off other loans, advances or consumer debts.
A $1000.00 administration fee is charged to the borrower at the closing.
Buyers must attend an ADA -approved homebuying seminar.

Maximum limits for 2011 are as followed
